These Terms of Use (the Terms) constitutes a binding and enforceable contract between NEARBIS LTD. Mobile Application/Online Platform (“we”, “the Administrator”) and its Users (“you”).
The use of and your access to this Mobile Application/Website/Platform (“Our services”) are governed by these Terms. Please read these Terms carefully before accepting.

2. DEFINITIONS

  • “Artisans” refers to individuals or businesses offering services through our platform.
  • “User/Client/You” refers to individuals or businesses hiring artisans.

3. PLATFORM USE

  • To use or subscribe to the services of this platform, you agree to use this platform for legitimate purpose only.
  • Artisans must create account and provide accurate information.
  • Users/Clients must create account and provide accurate information.
  • Posting inappropriate content, spamming, or engaging in illegal activities are prohibited on this platform.

4. ARTISAN SERVICES

  • Artisans are independent contractors, not employees of NEARBIS LTD.
  • We do not guarantee the quality or outcome of artisans' work.
  • Users/clients engage artisans at their own risk.

5. PAYMENT TERMS

  • This platform is free for all users; although, it contains services that attracts charges.
  • The charges for such services may differ and depend on individual service and Artisans.
  • Payment on our Website is to promote the services.

6. REFUND POLICY

Payment made on our Website/App are not refundable.

7. DISCLAIMERS AND LIMITATIONS OF LIABILITY

You expressly understand that NEARBIS LTD. shall not be responsible for Artisans' credentials, qualifications, or work quality.
We do not guarantee the ability of Artisans and we do not have control over the quality of service.
We disclaim liability for:

  • Damages and/or losses resulting from the Artisans' work/services
  • Failure to meet expectations by Artisans
  • Disputes between Users/Clients and Artisans
  • Any other matter relating to the services.
  • User's interactions with any individuals.

8. INTELLECTUAL PROPERTY/TRADEMARK

  • NEARBIS LTD. owns platform content and intellectual property.
  • The name NEARBIS LTD. and the NEARBIS logo are Trademark of NEARBIS Limited.
  • NEARBIS respects the intellectual property of others, and we ask our users to do the same.

9. INDEMNITY

  • You hereby agree to indemnify and hold NEARBIS LTD., its agents, affiliates, successor, partners and/or representatives harmless from any claim including reasonable attorney fees, made by any third-party claim due to or arising from: your use of the platform; any registration information provided by you; your violation of the Terms of Use; your violation of any applicable law, regulations, or rule. The administrator reserves the right to defend such matter at your expenses and you agree to cooperate with our defense of same.

10. PRIVACY POLICY

  • You agree that the Administrator may retain the registration information you submit to us by creating an Account on this platform and use such information and Use Content or data as incidental to the operation of services as described in this Terms of Use and Privacy Policy.

  • This Terms of Use and relationship between you and NEARBIS Limited shall be govern by the laws of the Federal Republic of Nigeria.
  • You and NEARBIS Limited agree to submit to the jurisdiction of the Courts located within Oyo State of Nigeria in relation to any claim arising from this Terms of Use.
  • You agree that without regards to any provision of any statute or law to the contrary, any claim arising from the use of our services must be filed within one (1) year failure which the right to such claim shall be automatically extinguished.
